Changes in the economy, society and technology are provoking widespread reflection on the future of work. Issues under discussion include the impact of automation on jobs that currently exist, as well as the nature of new jobs that are emerging in the gig economy. These modern debates combine with longer-standing concerns about the weakening of the collective power of workers and the growth of precarious forms of employment. Paul Carey - Law and French Graduate is recently announced as a Fulbright Awardee
Mr Paul Carey is a graduate of Law and French at TCD and is currently serving as a Judicial Assistant to Mr Justice Peter Charleton of the Supreme Court. As a Fulbright Awardee, Paul will undertake a LLM focusing on public international law at Columbia University. He intends to examine the international legal order from substantive and philosophical perspectives, and to research current and pressing issues in the areas of international humanitarian law, international criminal law, and global governance. With the opportunity to study under leading international law scholars and in proximity to the UN, he aspires to gain a pivotal insight into his field.

The winners were Niamh Martyn (SF Law and French, first prize) and Olivia Moore (JF Law and Political Science, second prize), who received their prizes at a prize-giving ceremony and luncheon hosted on Friday 29 March 2019 by William Fry partners Paul White, Brian O Callaghan, Adam Synnott, Sergey Dolomanov, and Trainee and Intern Programme Manager Susan Wyer.
The winning essays offered critical analysis of the law concerning damages awards in the Courts and the duty of care in negligence, respectively.

On 15 April 2019, the Irish Banking Culture (IBCB) appointed Professor Blanaid Clarke, McCann FitzGerald Chair in Corporate Law to its Board. Today the Irish Banking Culture Board (IBCB) was officially launched following an in-depth public and stakeholder consultation and a separate bank employee culture survey, which were undertaken to inform the IBCB’s establishment.

The European Survey on Prison Oversight Bodies (ESPO) is the first cross-national survey on prison oversight bodies. Reputation as Property: Perspectives from Tort and Property, Friday, 18 January 2019
How can tort law account for the harm of defamation? One answer to this question is to argue that our reputation is or is like property. While this analogy may make sense to tort theorists, particularly those seeking to give an internal account of tort law, it may not make sense to property theorists. In addition, it is not clear whether this approach fits with the case law. Whether or not thinking about reputation as property makes sense raises the question of whether tort law theory understands property differently than property theory does.

Culture, Diversity and the Way Forward in Ireland’s Financial Sector
A conference, jointly hosted by the School of Law, under the directorship of Professor Blanaid Clarke, McCann FitzGerald Chair in Corporate Law and the Central Bank was held in Trinity College Dublin on 25 October last. Minister for Finance and Public Expenditure and Reform, Paschal Donohoe the conference which examined the Central Bank’s ‘Review of Behaviour and Culture of the Irish Retail Banks’ and considered the lessons to be drawn from it for all firms in the financial services sector.

Consent in Criminal Law - Roundtable, Saturday, 13 October 2018
Modern liberal legal systems place remarkable weight on consent when it comes to the permissibility or criminality of interpersonal action. Consent is the vehicle by which autonomy is exercised and respected. Its presence or absence decides whether an act is a serious crime or something benign or neutral. This emphasis on consent contrasts sharply with certain traditional or non-liberal societies where factors apart the immediate choice or attitudes of the parties determine the permissibility or non-permissibility of interactions and sexual relations in particular. Consent, and its so-called transformative power, however, has come under increasing scrutiny lately not from conservative quarters but rather from within liberal theory and from new lines of feminist enquiry.

The Crime and Punishment Research Group is pleased to announce a public lecture, "Victims, the Public Interest and the Criminal Process", by Prof Shane Kilcommins, University of Limerick. Professor Shane Kilcommins is Professor of Law and Head of School at the University of Limerick School of Law. His is a graduate of the University of Limerick (BA in Law and European Studies, 1994), the University of Wales, Aberystwyth (PhD, 1999) and University College Cork (MA in Teaching and Learning, 2007). He joined the School of Law at the University of Limerick in 2014 after lecturing at University College Cork for 13 years. His areas of specialisation include criminal law, jurisprudence and penology and he has published books, peer reviewed articles and reports on a wide range of criminal justice issues including the needs of victims of crime.

Trish youth justice policy and practice has made major strides over the past 15 years. Legislative and policy reform and substantial investment have created a youth justice system that is largely progressively and in line with international human rights standards and accepted principles of good practice. The imminent expiry of the Youth Justice Action Plan 2014-2018 suggests that it is timely to consider the priorities of the next national policy in this area. Professor of Criminology at Loughborough University, Stephen Case will provide a keynote address on his research on the ‘Positive Youth Justice’ framework, how it was developed and how it is being used to advocate youth justice reform in England and Wales.

A great deal has been happening in tort litigation over recent months. The Supreme Court has handed down several important judgments, on the duty of care, professional negligence, economic loss, and the liability of public authorities. The Court of Appeal has been extremely busy on issues relating to the calculation of damages, occupiers’ liability, employers’ liability and defamation. Judges of the High Court have handed down very many judgments on all aspects of practice and procedure in tort litigation as well as emerging areas of liability.

Plain Packaging of Tobacco - Seminar Tuesday, 12 June
Australia and Ireland were the first two countries in the world to introduce legislation to require standardized packing of tobacco products. There will be a seminar on this topic from 2:00pm to 4:00pm on Tuesday 12 June 2018 in the Neill Lecture Theatre in the Trinity Long Room Hub. Lunchtime Seminar by Thomas A. Barnico - Monday 28 May
The Constitutional Governance and Social Change Research Group will be hosting a lunchtime seminar on Monday 28 May 2018, 13.00-14.00 in Room 11, House 39, to which all students and staff are warmly welcome. Mr. Barnico is an Adjunct Professor at Boston College Law School and he was Assistant Attorney General, Commonwealth of Massachusetts, 1981-2010. He represented the state and its officers in civil cases involving constitutional law, administrative law, and business regulation. He has argued three cases in the United States Supreme Court, eighteen cases in the United States Court of Appeals for the First Circuit, and more than 70 cases in the Supreme Judicial Court for the Commonwealth.

Dr. Pin will be speaking on "The Dismay of Progress: The deception of irenic constitutionalism". Professor Pin is Associate Professor of Comparative Law, University of Padua and is a Senior Fellow and Visiting Scholar at the Center for the Study of Law and Religion at Emory University.

The Private Law Research Group presents “A Liberal Theory of Property” by Prof Hanoch Dagan. Hanoch Dagan is the Stewart and Judy Colton Professor of Legal Theory and Innovation and the Director of the Edmond J. Safra Center for Ethics at Tel-Aviv University. Professor Dagan has been a visiting professor at Yale, Columbia, University of Michigan, Cornell, UCLA and University of Toronto. He is also a Senior Fellow at the Israel Democracy Institute and a member of the American Law Institute and of the International Academy of Comparative Law.Professor Dagan has written seven books – Unjust Enrichment: A Study of Private Law and Public Values (Cambridge University Press, 1997), The Law and Ethics of Restitution (Cambridge University Press, 2004), Property at a Crossroads (Ramot, 2005) (in Hebrew), Property: Values and Institutions (Oxford University Press, 2011), Properties of Property (with Gregory S. Intelligent Machines: Who (or What) Creates a Work of Authorship – 25 January 2018
In copyright law, an author is a human being who exercises subjective judgment in composing the work and who controls its execution. But challenges arise when the putative author partners with a machine or with natural forces to create a work of authorship. Do mechanical or natural interventions in the production of a work result in an insufficiently human-authored creation? The burgeoning of “computer generated works” – outputs of digital neural networks that have “taught themselves” to combine rules of literary, musical or artistic assembly after being “trained” on a database of pre-existing works – requires us to ask whether those outputs are “original works of authorship” entitled to copyright protection. This talk by Prof Jane Ginsburg, Morton L. Janklow Professor of Literary and Artistic Property Law at Columbia University (School of Law) will first review non-digital examples in order to derive principles of copyright authorship to apply to computer-implicated outputs. Application of the principles will yield different outcomes depending on whether the output is computer-assisted or truly computer-generated. If divergent treatment of otherwise potentially identical human-generated and machine-generated works seems problematic, it becomes necessary to inquire whether copyright’s core assumption – that the “author” is a human being – requires reconsideration. That rethinking must take into account the justifications for copyright protection; as we will see, different justifications produce varying assessments of whether computer-generated works “belong” in copyright.

Litigation Against Schools: The Contemporary Challenges for School Management / Conference, Saturday, 2 December 2017
School management today is faced with several challenges. Technology brings dangers as well as benefits. Legislation requires schools to deliver several policies, each of them excellent in isolation, but difficult to accomplish in combination. Courts and tribunals scrutinise procedures to ensure that school management complies with the requirements of health and safety, the duty of care, due process and equality. The task is not impossible but it certainly is demanding.

The Trinity College Law Review is delighted to welcome Cass Sunstein on the 10th of November. Cass Sunstein is a renowned Harvard law professor, specializing in constitutional law, administrative law, environmental law and behavioural economics. From 2009 - 2012, he was Administrator of the White House Office of Information and Regulatory Affairs. Sunstein is also the founder and director of the program on Behavioural Economics and Public Policy at Harvard Law School. He has been involved with law reform and the writing of constitutions in many nations, including Ukraine, Poland, China, South Africa and Russia. He has been Samuel Rubin Visiting Professor of Law at Columbia. He was a faculty member at the University of Chicago Law School from 1981 to 2008.
The Denham Fellowship
The Denham Fellowship, named after The Hon. Mrs. Justice Susan Denham, former Chief Justice, assists two aspiring barristers annually who come from socio-economically disadvantaged backgrounds to gain access to professional legal education at the King’s Inns and professional practice at the Law Library.

Berkeley Equality Law Conference at Trinity College Dublin
On 15-16 June 2017, academics, lawyers and rights advocates from all over the world attended the annual conference of the Berkeley Comparative Equality and Anti-Discrimination Study Group at Trinity College Dublin. The conference included keynote addresses by former president Mary Robinson and former Irish judge at the European Court of Human Rights Ann Power-Forde. 27 papers were presented by participants from 17 countries, including India, China, Australia, Canada and the USA. Themes examined included the impact of Brexit and the Trump administration on anti-discrimination laws; transgender equality rights; anti-discrimination and religious diversity; and the implementation of the UN Convention on the Rights of Persons with Disabilities. The Anti-Discrimination Study Group was formed in 2012 and it brings together a global network of academics, legal practitioners, and rights activists with an interest in law and equality

Recent Developments in Tort Litigation 2017 - Saturday, 17 July 2017
2017 has already yielded a rich harvest of judgments from the Supreme Court, Court of Appeal and High Court. The Supreme Court, as recently as June, handed down an important decision on the duty of care and negligent misstatement. The Court of Appeal has addressed the RRR in assessing damages awards. Significant judgments on occupiers’ liability, defamation and PIAB have also been delivered. The issue of employers’ liability for bullying in the context of disciplinary proceedings has been addressed by the Supreme Court.

Dr Niamh Connolly is a lecturer at University College London, where she moved from Trinity College Dublin in 2016. Her principal research and teaching interest is in unjust enrichment law. She is interested in how Irish private law compares to that of England and Wales, and in differences in legal culture that affect the substantive law in these jurisdictions. Her paper will seek to interpret the sparse Irish case law on unjust enrichment in light of this wider question about the specificity of Irish law. In particular, Niamh will ask whether Irish legal culture is less formalist than that of England and Wales, and if so, how that affects Irish restitution law. Niamh hopes that the seminar will provide an opportunity to hear the views of other Irish jurists as to the possible distinctiveness of Irish judicial approaches in private law.

Paid traineeships at the European Union Intellectual Property Office (EUIPO) and the European Patent Office (EPO)
In October 2016 the School of Law at Trinity College Dublin became a strategic partner of the ‘Pan-European Seal’ Professional Traineeship Program after having signed a Memorandum of Understanding with the European Intellectual Property Office (EUIPO). The Pan-European Seal offers 100 traineeship posts every year, administered by both Offices (number of posts offered by each Office will be determined annually). This scheme gives young university graduates a unique first-hand experience of the European Union in general and the Office in particular. It is also an opportunity to put into practice the knowledge acquired during their studies, in particular in their specific areas of competence. In addition, it helps them understand the objectives and procedures relating to the European Union trade mark and Community design system, as well as to IP infringement and enforcement matters.

Key Recent Developments in Tort Litigation
The courts have handed down a huge number of highly important decisions, on such matters as the duty of care of public authorities, the use of certificates by architects and engineers in construction projects, the calculation of damages in wrongful death claims, professional negligence claims against lawyers and doctors, the role of juries in defamation proceedings and the obligations of employers at common law and under the Safety, Health and Welfare at Work Act 2005.
The Value of Establishing Medical-Legal Partnerships to Serve Vulnerable Populations
Guest Speakers: Prof Jonel Newman and Melissa Swain of the University of Miami, School of Law. Medical and legal service providers working together have had demonstrable success in reducing health inequities and preventable illnesses in children and other vulnerable populations, including immigrants and refugees, and persons from impoverished and isolated communities. In the United States, 292 health provider agencies, 152 civil legal aid agencies, 51 law school clinics and 71 pro bono provider agencies have established Medical-Legal Partnerships to address legal needs that adversely affect health. Recently, Canada and Australia have adopted this multidisciplinary model to address the legal needs of children and families living in poverty.
