About the Course

The Extra-Mural course in White-Collar Crime at Trinity College Dublin aims to provide participants with an up-to-date understanding of the subject. The course integrates an analysis of substantive corporate criminal law issues with a consideration of key procedural issues, enabling practitioners to further appreciate how the law is developing and how to advise clients and conduct litigation in practice.

In particular, the course will discuss the enhancing criminalisation of corporate conduct, issues of investigating, prosecuting and defending white-collar crime in practice, how proceeds of crime and money laundering regimes interrelate with business crimes and recent developments in sentencing and ancillary civil penalisation measures. Further considered is how corporate fraud is an increasing concern for Irish businesses, how it occurs and how corporate fraud investigations are conducted.

Throughout the course, attention is focused upon topical and emerging judicial and legislative developments in the area and on the effects of these developments on the subject in practice.

Speakers

SHELLEY HORAN is a practicing barrister, an adjunct assistant professor of law in Trinity College Dublin and the author of Corporate Crime (Bloomsbury Professional, 2011).

DR JOE MCGRATH is a lecturer in law in NUI Galway, his PhD was on white-collar crime (it was entitled "Criminalising Companies and Companies Officers: A new Architecture of Regulatory Enforcement") and he has published widely on the subject.

JAMES HAMILTON was appointed Director of Public Prosecutions in 1999 and he retired in 2011. Prior to that he practiced as a barrister and was an adviser to the Attorney General. Mr Hamilton was elected President of the International Association of Prosecutors in 2010.

SHANE MURPHY is a Senior Counsel and an experienced practitioner in both criminal law and commercial law. He has delivered many presentations on the subject of white-collar crime and acted as consultant editor to the legal text, Corporate Crime (2011).

DECLAN O'REILLY is the Bureau Legal Officer of the Criminal Assets Bureau. He is a graduate of the Advanced Diploma in Corporate, White-Collar and Regulatory Crime in King's Inns, is involved in international associations relating to the proceeds of crime and has spoken extensively on the subject.

PAULA REID is a Partner in A&L Goodbody's Knowledge Team and has spoken and written extensively on the topic of money laundering and is the co-author of "Money Laundering Risks and Liabilities" (2nd Edn, First Law, 2007). She advises clients on their anti-money laundering compliance obligations and is involved in developing money laundering compliance training programmes for them.

REMY FARRELL is a Senior Counsel who regularly prosecutes and defends white-collar crime. He also frequently delivers presentations on the subject and is co-author of the legal text, the European Arrest Warrant in Ireland (Clarus Press, 2011).

DR DAVID MCFADDEN is the legal advisor to the Competition Authority and has been involved in the prosecution of criminal cartels. He has a PhD in the area of competition law and regularly speaks at conferences on the subject.

LAURA BURGE and LISA CATHCART of Deloitte Forensic regularly investigate frauds on behalf of their clients, whether domestically or abroad and have extensive experience in conducting and managing fraud investigations.

19 February 2013	Practical Issues in Investigating Corporate Fraud, including: From sophisticated frauds resulting in loses of tens of millions of Euros to low level expenses fraud, corporate fraud is an increasing concern for Irish businesses. Corporate fraud in today's environment, how corporate fraud arises and provide insight into the management of a corporate fraud investigation. Guidance on how to advise clients in practice where a potential fraud has been discovered. Lecturers: Laura Burge and Lisa Cathcart

 
This Extra-mural course is derived from the Corporate, White-Collar and Regulatory Crime module taught on the Master in Laws degree programmes at the School of Law. The extra-mural course is suitable for individuals with professional experience in the subject matters whether legal or otherwise.
